Washington sets the sanctions act's tariffs and waives them in the same order

16 Oct 2026 Washington

What happened

On 16 October 2026 President Donald Trump signed the executive order "Implementing the Lindsey O. Graham Sanctioning Russia and Iran Act of 2026". Section 2 sets the act's duty increases: 500 per cent ad valorem on goods from Russia; 100 per cent on goods from the five largest importers of Russian-origin crude oil and natural gas if they knowingly make new purchases on or after 18 October 2026; and 100 per cent on goods from the top five facilitators of Russian oil sanctions evasion. Section 4(a), invoking section 115(a) of the act and a certification to Congress that the waiver is in the national interest, waives those duties. Sections 4(b) and 4(c) waive the act's sanctions provisions in sections 102(a), 102(d), 102(e), 103 to 111 and 117, and state that sanctions under the executive orders on the national emergency with respect to Russia, continued on 24 March 2026, are unaffected, including for everyone designated under them. Section 4(d) keeps the waivers in effect until the President or the Secretary of State, in consultation with the Secretary of the Treasury, determines that further action is appropriate; no expiry date is set. Section 3 orders monitoring of purchases of Russian crude oil and natural gas and of sanctions evasion. The order's operative text contains no provision on Iran.

THE AUTHORITY WAS USED TO SET ITSELF ASIDE. Four weeks after the act was signed, its central mechanism has been exercised for the first time, and in the same instrument suspended: the rates now exist in an executive order, two days before the date that would have brought the buyer tariff into play, and none of them applies. The order follows General License 135 of 9 October, so within eight days the executive relaxed both the licence side and the statutory side of the American architecture, which is the property that architecture is recorded for. What it does not do is as important: the designations made under the earlier executive orders stay in force, provisions of the act the order does not name are not waived by it, and nothing in the text says how the duties would be administered if a waiver were withdrawn. It establishes the legal state on 16 October, not an intention: the observable is a waiver withdrawn or narrowed, or a named buyer, rate and date. The act's title names Iran; the order does not act on Iran, and it is not Iran sanctions relief.
