The IAEA Board refers Iran to the Security Council

What happened

The Board of Governors holds a special session on 7 September at which Director General Rafael Grossi states that the Agency is unable to verify the status of Iran's declared nuclear material and facilities for want of access and information, and calls the situation a matter of serious proliferation concern to be addressed with the utmost urgency. On 9 September the Board adopts a resolution submitted by France, Germany, the United Kingdom and the United States finding Iran in non-compliance with its safeguards obligations and referring the file to the United Nations Security Council, by 23 votes to 3 with 8 abstentions. Iran's permanent representative in Vienna, Reza Najafi, calls the resolution a political tool; the Foreign Ministry spokesman, Esmail Baghaei, had said before the vote that Tehran would take countermeasures if the file was referred. No countermeasure has been announced as at 13 September, and no inspection has been carried out at any declared site other than Bushehr since the war opened.

THE FILE HAS MOVED FROM A TECHNICAL BODY TO A POLITICAL ONE, AND THAT IS THE WHOLE OF WHAT HAPPENED. A referral changes the forum, not the facts: the Agency's position on 9 September is the same position it held on 4 June, and nothing in the resolution restores access, obtains an inspection or establishes anything about the programme. It matters for two reasons that have nothing to do with enrichment. First, it exhausts the Agency's own escalation ladder — after a referral the Board has no further step, so the question of what to do about Iranian non-cooperation now belongs to a Council on which two permanent members can veto any measure, which is why the move is widely read as declaratory. Second, it removes the last procedural reason for Tehran to keep the Agency's file open as a bargaining position, and the module's nuclear observable — an inspection actually carried out at a declared site other than Bushehr — becomes harder to meet, not easier. What this record does not do is grade Iran's conduct. The absence of verification establishes neither that enrichment continued nor that it stopped, in this week as in every week since February, and the referral does not change that symmetry.
